Apex Funding Inc., doing business as Apex Funding Services ("Apex," "we," "us"), is a commercial finance broker based in New York. This policy explains what information we collect when you visit apexfundingservices.com, apply for business funding, or work with us as a partner, how we use and share it, and the choices you have. We arrange business-purpose financing only; we do not offer consumer loans.
Information we collect
Information you give us. When you fill out a form, apply, call, text or email us, we may collect:
Contact details: name, business name, email, phone number and mailing address
Business information: industry, time in business, monthly revenue, tax ID (EIN), funding amount requested and use of funds
Financial documents: business bank statements, tax returns, financial statements, invoices, equipment quotes and existing financing details
Owner information: date of birth, home address, ownership percentage, government ID and Social Security number, which funders use for identity verification and credit review
Partner information: for ISOs and referral partners, company details and commission payment information
Information collected automatically. Our website is hosted by Squarespace, which uses cookies and similar technologies to collect device and usage data such as IP address, browser type, pages viewed and referring site. This helps the site work and helps us understand traffic.
Information from others. With your authorization, funding partners and service providers may obtain credit reports, bank verification, public records, and business and identity verification data about your business and its owners.

How we share your information
We share information only as needed to do what you asked us to do, or as described here:
Funding partners: direct lenders, merchant cash advance providers and other funders who review your application. Each funder handles your information under its own privacy policy.
Service providers: companies that host our website, store files, process forms and email, or verify identity and bank data for us, under obligations to protect it
Referral partners: if a partner referred you, we may share the status of your application with that partner
Legal and safety: when required by law, subpoena or regulation, or to protect against fraud
Business transfers: in connection with a merger, sale or transfer of our business
We do not sell your personal information.
Calls, texts and email
By submitting your phone number, you agree that Apex may contact you about your request by call, email or text message, including through automated technology, as described in the consent you give on our forms. Funding partners that receive your application may contact you directly about your request under their own policies. Consent to marketing calls or texts is not a condition of receiving funding. Message and data rates may apply. Reply STOP to opt out of texts, or use the unsubscribe link in any marketing email. Mobile phone numbers and SMS opt-in consent are not shared with third parties or affiliates for marketing or promotional purposes.
How we protect your information
We use reasonable administrative, technical and physical safeguards, consistent with the New York SHIELD Act, to protect the information we hold. We will send you a secure upload link for sensitive documents. Never email your Social Security number or bank login credentials. No system is completely secure, and we cannot guarantee absolute security.
How long we keep information
We keep information for as long as needed to provide our services, maintain business records, resolve disputes and meet legal requirements, and then delete or de-identify it.
Your choices and rights
You can ask us to access, correct or delete the personal information we hold about you
You can opt out of marketing emails and texts at any time
You can set your browser to refuse or delete cookies; some site features may not work as a result
California residents may have rights under the California Consumer Privacy Act, including the right to know, delete and opt out of the sale or sharing of personal information; we do not sell or share personal information for cross-context behavioral advertising. Information already shared with a funding partner is also subject to that funder's policy, and we will tell you how to reach them.
Children
Our services are for businesses and their adult owners. We do not knowingly collect information from anyone under 18.

Our site may link to other websites, including funding partners. We are not responsible for their privacy practices.
Changes to this policy
We may update this policy from time to time. The effective date at the top shows when it last changed.
