I agree to accept and acknowledge that I have chosen to utilize an electronic signature for the purposes of submitting an application for working capital. This electronic signature is intended by all the parties to be treated the same as an ink signature, and all parties may rely on this electronic signature as if it is an ink signature.

Application Representations and Authorization

The Merchant and Owner(s)/Officer(s) identified above (individually, an “Applicant”) each represents, acknowledges, and agrees that (1) all information and documents provided to Apex Funding Inc., doing business as Apex Funding Services (“Apex Funding Services”), are true, accurate, and complete to the best of the Applicant’s knowledge, (2) Applicant will promptly notify Apex Funding Services of any material change in the information provided, (3) each Applicant is authorized to sign this form on behalf of the Merchant, (4) Applicant authorizes Apex Funding Services to transmit this application, along with the information and documents provided in connection with it, to the funding partners to which Apex Funding Services submits this application (the “Recipients”) for the purpose of evaluating the request for financing, and (5) Applicant authorizes any creditor or financial institution to release information relating to the Applicant to Apex Funding Services and to the Recipients for that purpose. Apex Funding Services is a broker and not a lender. It does not make credit decisions, and submitting this application does not obligate the Applicant to accept any offer. This authorization is valid for one hundred twenty (120) days unless revoked in writing by the Applicant. Nothing in this application waives any right or remedy the Applicant has under applicable law, and nothing in it releases Apex Funding Services or any Recipient from responsibility for its own negligence, misconduct, or violation of law.

Protection of Information

Apex Funding Services uses administrative, technical, and physical safeguards designed to protect the information you provide. We disclose your information only to the Recipients, to credit reporting agencies and verification services where you have authorized it, to service providers that help us operate, to our professional advisors, and as required by law or legal process. We do not sell your personal information. Our Privacy Policy describes how we collect, use, and share information and explains your choices and rights.

Confidentiality

Apex Funding Services will treat the information in this application as confidential and will use and share it only as described in this application and our Privacy Policy. Offers and financing documents you receive from a Recipient may contain terms that the Recipient treats as confidential. You may share any offer or document with your attorney, accountant, financial advisor, or other professional advisor. Nothing in this application restricts you from communicating with a government agency or regulator, or from disclosing information as required by law.
